If you're a Covered Entity (you are)
Dental practices are Covered Entities under HIPAA. That's not in question. The question is whether a specific tool or interaction involves PHI. Being a Covered Entity doesn't mean every piece of technology you touch requires HIPAA compliance. Your practice's Yelp page isn't HIPAA-compliant. Your Google Ads account isn't HIPAA-compliant. Your website's contact form isn't HIPAA-compliant. Because none of those things handle PHI.
A chatbot that collects lead information falls into the same bucket — unless it's designed to handle PHI, in which case it needs appropriate protections.
Business Associate Agreements (BAAs): Do You Need One?
A Business Associate Agreement is a contract between a Covered Entity (your practice) and a vendor that handles PHI on your behalf. It spells out the vendor's obligations for protecting that PHI.
You need a BAA with your chatbot vendor if:
- The chatbot stores, processes, or transmits PHI
- The chatbot integrates with your EHR or practice management software
- The chatbot conducts symptom assessments or triage
- The vendor has access to conversation logs that contain PHI
You probably don't need a BAA if:
- The chatbot only handles general inquiries and lead capture
- No clinical information is solicited or stored
- The chatbot doesn't connect to any patient record systems
- Conversation data is limited to name, contact info, and general service interest
That said, even if a BAA isn't technically required, it's not a bad idea to have one anyway. It demonstrates due diligence and protects both parties. Many chatbot vendors will sign a BAA regardless.
